Abstract:
A presente dissertação tem por objetivo demonstrar que a Residência Jurídica tem potencial para contribuir com a humanização do ensino jurídico. A Residência Jurídica observada é a Especialização em Prática Jurídica Social - Residência Jurídica, da Universidade Federal do Rio Grande (FURG). O método de abordagem utilizado é a pesquisa participante combinada com as técnicas de pesquisa bibliográfica, questionário contendo questões abertas, fechadas e de múltipla escolha, além da observação participante registrada em um Diário de Campo. Para atingir o objetivo proposto, este trabalho apresenta em seu primeiro capítulo uma breve retomada na história do ensino jurídico no Brasil, dividida em marcos considerados de notável relevância para sua evolução. No segundo capítulo, a proposta é estabelecer uma conceituação operacional a respeito do que é aqui entendido como a humanização do ensino jurídico, tendo-se como referência o pensamento de Paulo Freire. O terceiro capítulo busca traçar um breve panorama da pós-graduação no país desde seu surgimento, bem como descrever a experiência da Residência Jurídica da FURG, objeto da pesquisa, e apontar sucintamente outras experiências desse tipo em curso no país. Ainda neste capítulo se buscará explicar detalhadamente a metodologia empregada. Por fim, no quarto e quinto capítulo, o objetivo é analisar qualitativamente os dados coletados no questionário e na observação participante (diário de campo) a partir das categorias conceituais de humanização do ensino desenvolvidas no segundo capítulo. As conclusões obtidas confirmaram a hipótese de que a Residência Jurídica tem potencial para contribuir com o que aqui se chamou de humanização do ensino jurídico.
The present dissertation aims to demonstrate that the Legal Residence has the potential to contribute to the humanization of legal education. The Observed Juridical Residency is the Specialization in Social Juridical Practice - Legal Residence, Federal University of Rio Grande (FURG). The approach used is participant research combined with bibliographic research techniques, a questionnaire containing open, closed and multiple choice questions, in addition to participant observation recorded in a Field Journal. In order to reach the proposed objective, this work presents in its first chapter a brief resumption in the history of legal education in Brazil, divided in milestones considered of remarkable relevance for its evolution. In the second chapter, the proposal is to establish an operational conceptualization regarding what is understood here as the humanization of legal education, taking as reference the thought of Paulo Freire. The third chapter seeks to give a brief overview of the postgraduate course in the country since its inception, as well as to describe the experience of the Legal Residence of FURG, object of the research, and succinctly point out other experiences of this type in course in the country. Also in this chapter we will try to explain in detail the methodology used. Finally, in the fourth and fifth chapters, the objective is to qualitatively analyze the data collected in the questionnaire and participant observation (field diary) from the conceptual categories of humanization of teaching developed in the second chapter. The conclusions obtained confirmed the hypothesis that the Legal Residence has the potential to contribute to what has been called humanization of legal education.
