Abstract:
A Assessoria Jurídica Universitária Popular forma-se no meio acadêmico a partir de projetos de extensão universitária e, na comunidade, por meio da assessoria em movimentos populares, sindicatos, organizações não governamentais etc., incessantemente conectada ao universo dos direitos humanos. Ademais, tem a clara intenção de conduzir o Direito frente a um ideal emancipador e transformador, manifestando-se como opção à prática jurídica tradicional. Ela advém do pressuposto de que só uma sociedade consciente e sabedora de seus direitos é dotada de capacidade para buscar a efetiva transformação social, desenvolvendo projetos de educação em direitos humanos. O presente trabalho estrutura-se em um estudo sobre a Assessoria Jurídica Universitária Popular como um instrumento de transformação social e, por conseguinte, patrono de direitos e garantias fundamentais e do acesso à justiça. Para isso, apontam-se algumas noções sobre suas perspectivas ideológicas, seus pressupostos e o acesso à justiça frente à realidade social. Ademais ressalta-se o seu papel no Estado democrático de Direito em relação ao princípio da dignidade da pessoa humana na luta pela consolidação de uma cidadania comum para a efetivação dos direitos humanos e fundamentais. Assevera-se a importância do tripé da educação: ensino, pesquisa e extensão, ratificando a relevância da última para a formação de uma sociedade composta pela pluralidade de valores, pela diversidade cultural e pela melhoria das múltiplas formas de regulação e emancipação das minorias sociais e segmentos populares desfavorecidos.
The Popular Academic Legal Advice is formed in the academic environment, from university extension projects, and in the community, through the advice of popular movements, unions, non-governmental organizations, etc., incessantly connected to the matter human rights. In addition, it has the clear intention of conducting the Law to an emancipating and transforming ideal, manifesting itself as an option to the traditional legal practice. It comes from the assumption that only a conscious society aware of their rights, is endowed with the capacity to seek effective social transformation, developing education projects about human rights. The present work is structured in a study on popular academic legal advice as an instrument of social transformation and, therefore, patron of fundamental rights and guarantees and access to justice. To this end, some notions about their ideological perspectives, their presuppositions and access to justice in relation to social reality are pointed out. In addition, it emphasizes its role in the Democratic State of Law in relation to the principle of the dignity of the human person in the struggle for the consolidation of a common citizenship for the realization of human and fundamental rights. The importance of the tripod of education has been affirmed: teaching, research and extension, ratifying the importance of the latter for the formation of a society composed of plurality of values, cultural diversity and the improvement of the multiple forms of regulation and emancipation of social minorities and underprivileged segments of the population.
