Abstract:
O presente estudo tem como objeto a norma inserida pelo Constituinte Originário no artigo 174 da Constituição Federal, a qual estabelece o caráter indicativo do planejamento econômico estatal para o setor privado da economia. Considerando que o planejamento econômico consiste em um processo técnico instrumentado para transformar uma dada realidade, com o fim de atingimento de objetivos fundamentais pré estabelecidos, o questionamento que se impõe é se a natureza indicativa do planejamento econômico estatal para os particulares poderia implicar em condutas que malfiram, sob o manto do princípio constitucional da livre iniciativa e da propriedade privada dos meios de produção, preceitos fundamentais que garantem que a ordem econômica deve voltar-se à valorização do trabalho humano, à dignidade da pessoa humana e à justiça social. Em suma, esse trabalho se debruça sobre o avanço do ideário neoliberal e seus efeitos sobre a desigualdade no Brasil.
The present study has as object the norm inserted by the Original Constituent in article 174 of the Federal Constitution, which establishes the inductive character of state economic planning for the private sector of the economy. Considering that economic planning consists of a technical process instrumented to transform a given reality, with the purpose of achieving pre-established fundamental objectives, the question that is asked is whether the inductive nature of state economic planning for private individuals could imply in conducts that even though indirectly and under the guise of the constitutional principle of free enterprise and private ownership of the means of production, fundamental precepts guarantee that the economic order must return to the value of human labor, the dignity of the human person and social justice. In short, this work focuses on the advancement of neoliberal ideology and its effects on inequality in Brasil.
