Abstract:
Pretendemos demonstrar, no presente artigo, que a vida social e,
inserida nesta, a vida jurídica, não decorre do desconhecimento das
normas positivas, mas sim revelam a necessidade de um
conhecimento mais profundo que pretendemos investigar. Disso
resulta a importância da investigação filosófica, pois esta surge como
consequência do despertar do espírito humano chamado
permanentemente ao conhecimento da verdade e a busca da
Sabedoria . Desse modo, o tema "Deus como Fonte do Direito" foi
tratado pela Escolástica, sobretudo Santo Tomás de Aquino e a
Escola Espanhola. Com isso queremos dizer que, para a Escolástica,
o Direito Natural aparece fundado em Deus.
This paper aims at showing that social life, including legal life, is not a
result of positive norms but reveal the need for deeper knowledge,
which is investigated here. Thus, there is the importance of
philosophical investigation, once it emerges as a consequence of the
awakening of human spirit called permanently for the knowledge of
truth and the pursuit of Wisdom. Therefore, the theme “God as the
Source of Law” was addressed by Scholasticism, mainly by Saint
Thomas Aquinas and the Spanish School. That is, for Scholasticism
Natural Law is based on God.
