Abstract:
O presente trabalho tem por objeto abordar a relevância da fundamentação das decisões
judiciais e as inovações trazidas pelo novo Código de Processo Civil, com o propósito de
reafirmar essa importante garantia constitucional. Em princípio, é abordado o contexto histórico
da fundamentação judicial nos ordenamentos jurídicos de maior influência e no Direito
brasileiro. Após, passa-se a examinar a fundamentação como garantia constitucional,
evidenciando, assim, os princípios inseridos na Lei Maior como norteadores da fundamentação.
Em seguida, apresenta-se o problema das decisões ausentes de fundamentação, denominadas
“decisões genéricas”. Por último, procede-se à análise das novas regras elencadas no novo
Código de Processo Civil como possível solução ao problema apresentado e, principalmente,
como reafirmação da garantia do direito fundamental à fundamentação das decisões judiciais e
a um processo justo ao cidadão.
This study’s purpose is to address the relevance of the reasoning of judicial decisions and
innovations introduced by the new Civil Procedure Code, in order to reaffirm this important
constitutional guarantee. In principle, it addressed the historical context of judicial reasoning in
the legal systems of greater influence and in the Brazilian law. After it passes to examine the
reasons as a constitutional guarantee, thus demonstrating the principles enshrined in the highest
law as guiding the grounds. Then we present the problem of missing decisions of reasoning,
called "generic decisions." Finally, we proceed to the analysis of the new rules listed in the new
Civil Procedure Code as a possible solution to the problem presented, and especially as a
reaffirmation of the guarantee of the fundamental right to the reasoning of judicial decisions to
citizens.
