Abstract:
O presente trabalho tem por objetivo a análise das decisões proferidas pelo Tribunal
de Justiça do Rio Grande do Sul no sentido de ter como resposta quais medidas são
aplicadas pelo Judiciário em casos de Alienação Parental, em especial a aplicação
da multa prevista pela lei 12.318/2010. Uma análise do tema será realizada, através
de conceitos doutrinários e da exposição da lei que dispõe sobre a Alienação
Parental. Com o tema relativamente novo para a sociedade e regulamentado pela lei
da Alienação Parental em 2010, se buscará ver se após 5 anos da promulgação da
lei, esta vem sendo aplicada e suscitada no Poder Judiciário nos litígios de família
envolvendo crianças e adolescentes.
This paper aims at analyzing the judgment given by the Court of Rio Grande do Sul
Justice in order to have an answer which measures are applied by the judiciary in
cases of parental alienation, in particular the application of the fine provided for by
Law 12,318 / 2010 . A subject of analysis will be performed through doctrinal
concepts and exposition of the law which governs the Parental Alienation. With the
relatively new issue for society and regulated by the law of Parental Alienation in
2010, seek to see if after five years of enactment of the law, this has been applied
and raised in the judiciary in family disputes involving children and adolescents.
