Abstract:
Este trabalho objetiva apreciar as inovações trazidas pela Lei no 13.245/2016, no que
tange ao direito de defesa na investigação preliminar, em vista de um processo penal
ainda calcado na cultura inquisitorial. Ressaltando os traços constitucionais trazidos
pela novel legislação, enquanto legitimadora da presença dos princípios fundamentais
na fase pré-processual, o presente foi dividido em três capítulos. O primeiro,
introdutório, analisa os três tipos de sistemas processuais penais reconhecidos pela
doutrina, bem assim a trajetória do direito processual penal no Brasil; o segundo traz
à tona os princípios constitucionalmente previstos que se correlacionam com a
investigação preliminar, para que, no último capítulo, sob o viés da matéria vista, se
proceda a análise dos aportes carreados na nova legislação, em vista de uma maior
aproximação do campo de estudo para com os ideais previstos na Lei Maior.
This work aims to assess the innovations brought by the Law no 13.245/2016, relating
of defense’s law in the preliminary investigation, with a view to criminal proceedings
still based on inquisitorial culture. Emphasizing the constitutional traits brought by the
novel legislation, while legitimizing the presence of the fundamental principles in the
preliminary investigation, this was divided into three chapters. The first, introductory,
analyzes the three types of criminal procedure system recognized by the doctrine, as
well as the trajectory of the criminal procedural law in Brazil; the second brings out the
constitutionally provided principles that correlate with the preliminary investigation, that
in the last chapter, under the bias of the field view if undertake analysis carted
contributions in the new legislation, in view of a closer field study to the ideals set out
in the Federal Constitution.
