Abstract:
O presente trabalho fará análise acerca do Direito à Identidade utilizando
conceituações dentro das áreas da sociologia, antropologia, psicologia e direito.
Inicialmente será analisada a emergência do Estado de Direitos a partir da
modernidade e a posterior construção da identidade cidadã no Estado brasileiro,
desde a Proclamação da Independência e seus reflexos na Constituição Federal de
1988. Em seguida será feita breve exposição acerca da modernidade e seus efeitos
na construção da identidade pessoal. Após, será analisada a construção do direito à
identidade e sua ramificação decorrente dos direitos da personalidade e seu viés
histórico, prático-jurídico, bem como será analisado o princípio da dignidade da
pessoa humana e como sua existência é capaz de influenciar promulgação de
legislações esparsas, a adoção de ações afirmativas e políticas públicas no Brasil
com objetivo de diminuir casos de discriminação racial e na esfera internacional, as
Declarações da ONU, que possuem a finalidade de erradicação de todas as formas
de discriminação.
The present study will analyse the Right to Identity using conceptualizations
within the areas of sociology, anthropology, psychology and law. Will initially be
analyzed the emergence of the state of rights from the modernity and the subsequent
construction of identity in the national Brazilian State since the proclamation of
independence and their reflections in the Federal Constitution of 1988. Then, will be
made brief explanatory about modernity and its effects in the construction of personal
identity. After, it will be given to the construction of the right to identity and its offshoot
from the rights of personality and its historical bias, practical and legal, as well as
consideration will be given to the principle of the dignity of the human person and as
their existence is able to influence the promulgation of sparse laws, the adoption of
affirmative actions and public policies in Brazil with the objective of reducing cases of
racial discrimination and the international sphere, the Declarations of the UN, which
have the purpose of eradication of all forms of discrimination.
