Abstract:
O presente trabalho, reservado à conclusão do curso de Direito da Faculdade de
Direito da Universidade Federal do Rio Grande, nomeado “Fator Previdenciário: um
(re)pensar panorâmico sob a ótica do princípio fundamental da vedação ao retrocesso
social e da dignidade da pessoa humana.”, estrutura-se em três capítulos.
Preliminarmente revela-se importante abarcar a Previdência Social sob a sinergia da
Seguridade Social, elencando princípios, bem como apresentando a evolução
legislativa global e nacional. Propõe-se analisar a mudança de paradigma do sistema
previdenciário pátrio, perfectibilizada através de Emenda Constitucional e legislação
apartada, apresentando às causas pertinentes da criação do Fator Previdenciário
frente a um cenário neoliberal, apreciando a fórmula anexa à legislação específica, a
partir de um método analítico, evidenciando as problemáticas advindas dos cálculos
deste coeficiente. Por fim, propor uma reflexão instigada em princípios e garantias
fundamentais e sociais conquistados ao passar de quase três séculos de história
legislativa nacional. Para dispor na temática previdenciária, corroborando-se com
objetivos mencionados, nos utilizaremos de pesquisa substancialmente teórica,
realizada a partir do levantamento bibliográfico (doutrina) e documental (legislação).
The present work, reserved for the completion of the law course at the Faculty of Law
at the Federal University of Rio Grande, named "Social Security Factor: a panoramic
(re)think from the perspective of the fundamental principle of the prohibition of social
recession and the dignity of the human person, is divided into three chapters.
Preliminarily proved important encompass Social Security under the Social Security
synergy, listing principles, as well as presenting the global and national legislative
developments. Proposes to examine the paradigm shift of Social Security system,
made possible through a constitutional amendment and legislation apart, presenting
the relevant causes of the creation of Social Security Factor front of a neoliberal
scenario, analyzing the attached formula to the specific legislation, from a method
analytical, highlighting the problems arising from the calculations of this coefficient.
Finally, we propose a reflection instigated on principles and fundamental and social
guarantees conquered in the course of nearly three centuries of national legislative
history. To avail the social security subject, corroborating with the goals mentioned, we
will use substantially theoretical research, carried out from the literature (doctrine) and
documentary (legislation) survey.
