Abstract:
A proposta da presente pesquisa tem como objetivo evidenciar a necessidade de
revisão de conceitos do Direito Civil, em especial do Direito das Sucessões e do Direito
de Família, sob a ótica constitucional, quanto aos efeitos jurídico-patrimoniais
decorrentes das uniões homoafetivas, a fim de demonstrar se tais uniões são capazes
de, por si só, gerar efeitos sucessórios ao companheiro supérstite. A metodologia
empregada baseou-se em uma pesquisa de abordagem dedutiva, considerando a
relação existente entre homossexualidade e Direito, especialmente quanto ao
tratamento dispensado por este àquela, perpassando pelos diferentes regramentos
atinentes aos direitos sucessórios no ordenamento jurídico pátrio; analisando o caráter
de entidade familiar das uniões homoafetivas; e discorrendo sobre os mecanismos de
proteção já existentes e sobre o casamento entre pessoas do mesmo sexo. Para tanto,
a pesquisa será estruturados em defesas doutrinárias sobre a temática. Procura-se
demonstrar a necessidade de cumprir-se a finalidade sucessória de justiça e
manutenção de patrimônio no seio familiar também em famílias homoafetivas.
The present research has the objective of makes the review of Civil Law concepts
need evident, especially about family e substitution, through the constitutional
perspective, over the patrimonial effects of homosexual unions, to show if this unions
are capable of create substitution effects for the living partner. The methodology
employed is based in a deductive boarding research, which will consider the connection
between homosexuality and Rights, especially about the treatment laws give for it,
talking about the different rules in substitution law in the Brazilian rights; investigate the
familiar characteristic of homosexual unions; and analyze the protection mechanisms
that already exist and homosexual marriage. To reach this objective the research is
based on doctrinal defenses about the subject. The object is to show the need of obey
the substitution law goal: justice and preserve the right of the families, including the
homosexual ones, maintain the death relatives patrimony
