Abstract:
O princípio da segurança jurídica é elemento basilar para a construção e
desenvolvimento das relações jurídicas, sociais e do Estado Democrático de Direito.
Para que esse princípio seja garantido se faz necessária a existência de
instrumentos capazes de promoverem sua preservação. O ordenamento
constitucional brasileiro é quem dá essas ferramentas aos legitimados para que seja
feita a defesa da segurança jurídica. O controle de constitucionalidade e a súmula
vinculante são institutos essenciais na manutenção desse princípio, zelando pela
Constituição Federal e visando equilíbrio e previsibilidade nas decisões do Poder
Judiciário. Esses institutos constitucionais são instrumentos da segurança jurídica e
fazem com que esse princípio atinja seu objetivo.
The principle of legal certainty is a fundamental element to the construction
and development of the legal, social and Democratic State of Law relations . For this
principle to be guaranteed the existence of instruments to promote its preservation is
required. The Brazilian constitutional system is who gives these tools for the
legitimated to make the defense of legal certainty. The control of constitutionality and
the binding precedents are essential institutes in maintaining this principle, ensuring
the Federal Constitution and seeking balance and predictability in decisions of
Justice. These constitutional institutes are instruments of legal certainty and make
this principle reaches its objective.
