Abstract:
O presente trabalho versa sobre a experiência da Justiça de Transição no Brasil, mais
especificamente da atuação das comissões da verdade no país, tendo em vista que estas têm
por escopo trazer esclarecimentos com relação às graves violações de direitos humanos
ocorridas durante os períodos de ditadura havidos no Brasil. Com base nisso, a partir de uma
análise dedutiva, partir-se-á da compreensão da Justiça de Transição, perpassando pela
compreensão da Comissão da Verdade, pautada no estudo da incidência da Comissão da
Verdade Federal e Estadual até atingir-se a experiência local, qual seja: a expectativa da
implementação da Comissão Municipal da Verdade em Rio Grande. Para tanto, intentar-se-á
trazer à tona a luta travada no Legislativo Municipal no intuito de possibilitar a aprovação da
Lei 7.905 de 17 de junho de 2015, que prevê a criação da Comissão Municipal da Verdade na
cidade; bem como serão traçadas as perspectivas que permeiam sua atuação e a repercussão
social desta medida em uma localidade considerada área de segurança nacional durante a
ditadura civil-militar brasileira que, apesar de se tratar de uma cidade interiorana, teve muita
influência do governo militar durante os anos de chumbo.
This work talks about the experience of Transitional Justice in Brazil, specifically
about the performance of the Truth Commissions in the country, given that they have the
scope to bring justifications about the human rights serious violations that occurred during
periods of dictatorship in Brazil. Based on this, from a deductive analysis it will start on the
understanding of Transitional Justice, passing by comprehension of the Truth Commission,
based on the study of the incidence of the National Truth Comission and the State Truth
Comission to be attained local experience, this is: the Truth Commission implementation in
Rio Grande City. Therefore, it‟ll brings the struggle in the Municipal Legislature in order to
enable the Law no 7.903, from June 17th 2015, adoption, which introduce the Municipal Truth
Commission in this town; as well as, it‟ll bring the perspectives that pervade his performance
and the social impact of this measure in a location considered national security area during the
Brazilian civil-military dictatorship, that, although, it was a provincial town, had to much
influence during the brazilian military government .
