Abstract:
A presente dissertação tem por objetivo investigar as relações entre a
implementação das políticas econômicas de cunho neoliberal e o fenômeno do
hiperencarceramento nos Estados Unidos e seus reflexos nas políticas econômica e
criminal na realidade brasileira, utilizando-se do aparato teórico da criminologia
crítica. A pesquisa foi realizada através do método bibliográfico, valendo-se de
autores de diversos ramos do conhecimento, principalmente da sociologia,
criminologia, direito, geografia e filosofia, nacionais e internacionais. Como principais
resultados obteve-se a confirmação da relação entre as modificações do modo de
produção, encolhimento do Estado e desregulamentação do mercado de trabalho
com o aumento vertiginoso do aparato repressivo, configurando a passagem ao
chamado Estado Penal, passando à esfera criminal a tarefa de gestão da miséria
gerada pelo neoliberalismo. Além disso, percebeu-se que tanto as políticas
econômicas neoliberais, quanto as políticas repressivas que as acompanharam nos
Estados Unidos foram implementadas no Brasil, gerando, na realidade nacional, um
punitivismo com características peculiares, marcado pelo encarceramento em massa
com condições desumanas dos estabelecimentos prisionais, policiamento repressivo
militarizado dos bairros despossuídos e política de extermínio dos excluídos do
mercado de trabalho.
The present dissertantion aims to investigate about the relationship between the
implementation of neoliberal economic policies and the phenomenon of hyper-
coercion in the United States and their reflexes in economic and criminal policies in
the Brazilian reality, using the theoretical apparatus of critical criminology. The
research was carried out through the bibliographical method, using authors from
several branches of knowledge, mainly from the national and international sociology,
criminology, law, geography and philosophy. The main results obtained were the
confirmation of the relationship between the changes in the mode of production,
shrinkage of the State and deregulation of the labor market with the rapid increase of
the repressive apparatus,configuring the passage to the so-called Criminal State,
passing to the criminal sphere the task of Misery generated by
neoliberalism.Furthermore,it was realized that both neoliberal economic policies and
the repressive policies that accompanied them in the United States were
implemented in Brazil, generating, in the national reality, a punitivism with peculiar
characteristics, marked by mass incarceration with inhuman conditions of
establishments Prisons, militarized repressive policing of the disenfranchised
neighborhoods, and the policy of extermination of those excluded from the labor
market.
