Abstract:
A presente pesquisa abrange a hermenêutica, o direito constitucional e discute o
avanço dos direitos de cidadania mais precisamente a possibilidade de criações
judiciais do direito entendendo que a realização da cidadania e da dignidade da pessoa
humana bem a construção de uma sociedade livre, justa e solidária são tarefas de
todos os poderes da República tendo em vista os arts. 1o, II, III e 3o III da
Constituição Federal. Trata-se de pesquisa exploratória, que utiliza o método indutivo,
com técnicas de pesquisa bibliográfica, mediante o estudo da doutrina, legislação e
jurisprudência acerca do tema proposto. Ficou demonstrado que a realização da
cidadania é uma tarefa afeta a todos os poderes da república, e que determinado
conteúdo da cidadania necessita, diante da omissão dos demais Poderes, de forte
atuação da Poder Judiciário e que este possui condições hermenêuticas,
constitucionais, bem como emergências sociais, para quando necessário criar direitos
de cidadania social existencial no caso concreto.
This research covers hermeneutics, constitutional law and discusses the advancement
of citizenship rights more precisely for judicial creations of the right understanding
that the realization of citizenship and human dignity and the construction of a free,
just and solidary They are tasks of all branches of government in view of the arts. 1,
II, III 3rd and III of the Constitution. It is an exploratory research, which uses the
inductive method, with bibliographic research techniques through the study of the
doctrine, legislation and jurisprudence about the theme. It was shown that the

content of citizenship needs because of the lack of other branches, strong performance
of the judiciary and that this has hermeneutical, constitutional conditions and social
emergencies when necessary to create existential social citizenship rights in this case.
