O ser humano como sujeito de direito internacional: a importância da implementação do jus standi in judicio da vítima perante a corte interamericana para a efetiva proteção dos direitos humanos

Abstract

O presente trabalho tem como objetivo a análise do Sistema Interamericano

de Proteção dos Direitos Humanos, especialmente no que diz respeito à

impossibilidade da vítima peticionar sua denúncia de forma direta à Corte

Interamericana (jus standi in judicio). Para tanto, será feito um apanhado histórico

sobre os direitos fundamentais e direitos humanos, bem como o desenvolvimento de

uma concepção contemporânea de Direitos Humanos. A seguir, far-se-á uma

comparação entre os sistemas europeu e interamericano de direitos humanos, com

análise de casos e evoluções históricas de cada sistema. Por fim, em busca de um

aprimoramento do Sistema Interamericano, dissertar-se-á acerca da importância do

acesso direto das vítimas de violações de direitos humanos à Corte Interamericana

para uma efetiva proteção dos direitos humanos.

The present work aims to analyze the Inter-American System of Human Rights

Protection, especially in what regards the impossibility of the victim to petition their

complaint directly to the Inter-American Court (jus standi in judicio). For this, it will be

a historical overview about fundamental rights and human rights, as well as the

development of a contemporary conception of human rights. Next, it will make a

comparison between the European and inter-American human rights systems, with

case studies and historical developments of each system. Finally, looking for an

improvement of the inter-be will speak about the important direct access of victims of

human rights violations to the Inter-American Court for effective protection of human

rights.
